Metro Enviro Litigation
Dear Croton Resident:

On September 27th at 8:00PM the Village Board of Trustees will hold a Public Hearing in the meeting room of the Stanley H. Kellerhouse Municipal Building to consider the Metro Enviro special permit renewal application and a proposed settlement of the issues between Metro Enviro and the Village.

On September 7th, the Board of Trustees held a Public Information Meeting to present and explain the proposed settlement.  In his presentation that evening, Special Counsel Michael B. Gerrard summarized the most important elements of the proposed settlement as follows:  

·       Metro Enviro would make very substantial monetary payments to the Village.
·       Metro Enviro could stay in operation as a C & D transfer station for now.
·       Metro Enviro would be subject to very clear terms for closure in the event of future violations.
·       Metro Enviro would be subject to more intense monitoring than it is now.
·       The Village would be allowed to use approximately 28,000 square feet of Metro Enviro property for its Department of Public Works operations – allowing the Village to begin its leaf composting program again.

The Village would be reimbursed for $440,000 of its litigation costs, paid a monitoring fee of $25,000 per year, and paid substantial Transfer Station Impact Fees.  

The Transfer Station Impact Fees that would be paid are:   

Year 1 – $4.00/ton resulting in revenue of approximately $528,000 to $600,000.
Year 2 - $5.00/ton resulting in revenue of approximately $660,000 to $750,000.
Year 3 - $5.25/ton resulting in revenue of approximately $693,000 to $787,500.
