NIR - Oral Argument Postponed
The Oral argument originally scheduled for January 4th at 11 am has been postponed until January 30th at 11 am.

On December 15, 2005 the Westchester County Solid Waste Commission voted to grant Northeast Interchange Railway a license to operate waste transfer facilities in Westchester County. The Village has also been advised by the New York State Department of Environmental Conservation that the permit previously issued to Metro Enviro Transfer LLC will soon be transferred to NIR.  

On December 21, 2005 Village Attorney Marianne Stecich appeared at Judge Nicolai's Supreme Court chambers with an order to show cause that included a temporary restraining order enjoining NIR from commencing transfer station operations at 1A Croton Point Avenue.  In his chambers she met with Judge Nicolai’s law clerk, James Garfein, and both Greg Photiadis (NIR’s attorney) and David Steinmetz (by conference call).  Mr. Photiadis and Mr. Steinmetz agreed that NIR would not commence transfer station operations before the oral argument scheduled for January 4, 2006 at 11:00am.
